Welcome to my weekly roundup of issues at the intersection of social media and the law. In this edition we look at the legal ramifications of using Web-based images in blog posts, managing digital assets from beyond the grave, EU criticism of Google?s privacy policy, efforts to legalize online poker, a government report calling for more regulation in the mobile industry, and a Canadian lawsuit that redefines employee privacy on company-owned computers. Web images, blog posts, and the law:

Bloggers, take note: just because you can copy and paste a picture from Google images doesn?t mean you should. Europe to Google: you?ve got four months:

European authorities released their report on Google?s privacy policy and associated practices this week, write Kolvin Stone and James Drury-Smith of law firm Orrick. The report, prepared by one of the EU?s toughest data protection regulators, the French Commission nationale de l?informatique et des libert?s, is highly critical of Google?s policy. But it isn?t all bad news for the Internet search giant, which escaped fines and sanctions, and was given four months to adapt their privacy policy to European standards. Watch this space. (Orrick)?

Betting on internet poker in the near future? The odds are getting better (but not by much). Senators Harry Reid and Jon Kyl released this week a draft of their online poker bill, mysteriously named the ?Internet Gambling Prohibition, Poker Consumer Protection, and Strengthening UIGEA Act of 2012.? The bill proposes legalizing internet poker at the federal level, creating an Office of Online Poker Oversight to regulate the industry, and allowing states and Indian tribes to opt in and affirmatively choose to participate in the program. Sound too good to be true? It may be: the bill in its current form is likely to face steep opposition from a number of parties, including states considering their own internet poker laws. But even if this version doesn?t pass, it?s an important first step for the future of online gaming. (Ifrah Law)?

GAO calls for greater regulation of location data in mobile industry:

The Government Accountability Office has released a report?calling for more federal regulation of the way that mobile industry companies collect and use location data. According to the report, users generally don?t know how the companies and third parties are using their data, or that they could be exposed to increased risks, such as identity theft and unauthorized police surveillance. Recommended actions include industry codes of conduct and FTC guidance for mobile companies (BuckleySandler)?

Canadian employees entitled to privacy on work computers:

Canada?s Supreme Court has ruled in R. v. Cole that employees ?may reasonably expect privacy in the information stored on their work-issued computers.? The decision found that workplace policies do not eliminate constitutionally protected privacy rights. For Terri Susan Zurbrigg and Greg Sim (Field Law), the ruling nevertheless demonstrates the importance of computer use policies for establishing ?the rules of the game? for employee use of workplace technology. This isn?t the final word on the subject, write Andrea Raso Amer and Eric Sherbine (from Fraser Milner Casgrain): the defendant did not challenge his employer?s actions, so the court did not look at employer rights to monitor computers used by employees. Soccer star, pop diva run in Ukraine's election

KIEV, Ukraine (AP) ? An extravagantly dressed pop diva, a retired football star, the son of a famous actor, an opposition leader suspiciously cozy with the government. Meet some members of the eclectic cast running in Sunday's parliamentary election in Ukraine.

Ukrainian political parties have brought in celebrities or even created fake opposition in an effort to boost their ratings and split their rivals' vote. Such tactics raise questions about Ukraine's commitment to democracy and its hopes of integrating with the West.

The two main pro-Western opposition parties hope to challenge President Viktor Yanukovych's nearly three-year grip on power. They aim to wrestle the parliamentary majority away from his Party of Regions and undo actions that have been judged undemocratic by the West, such as the imprisonment of charismatic former Prime Minister Yulia Tymoshenko.

The Party of Regions has tried to raise its profile by offering the No. 2 spot on its candidate list to pop diva Taisia Povaliy, which guarantees her a seat in Ukraine's parliament, the Verkhovna Rada. The 47-year-old blonde, who wears low-cut, floor-length gowns and sings about the pain of lost love, acknowledges that politics had never been her calling.

"I never thought that I would run for parliament, I never planned it. And then I discovered that people ? the people themselves ? want me to represent them," Povaliy said on a TV celebrity gossip program. "What difference does it make if I work on stage or in the Verkhovna Rada?"

Ukraine Forward, led by former Tymoshenko ally Natalia Korolevska, is widely believed to be supported by the ruling party and aimed at siphoning off opposition votes. Korolevska, a 37-year-old businesswoman-turned-politician, was ousted from Tymoshenko's party in the spring after she refused to support a motion calling for the jailed leader's release.

She went on to found her own party, hoping to attract Tymoshenko voters looking for an attractive, pro-Western female leader. Even though she denies any government links and is calling for the ouster of Prime Minister Azarov, Korolevska gets so much airtime on government-friendly television channels that she is viewed as a tool of Yanukovych's team.

To lead her party's candidate list, Korolevska brought in retired football star Andriy Shevchenko and actor Ostap Stupka, the less illustrious son of late renowned actor Bohdan Stupka. Giant billboards of her and the two celebrities went up along streets and roads.

Shevchenko, the 36-year-old striker known as Sheva, is extremely popular in Ukraine, but many wonder how he would make the transition to lawmaker.

In an interview with The Associated Press, Shevchenko said he planned to concentrate on sports and health issues in parliament and cited the poor athletic condition of many Ukrainian school students as one of the top problems in the country.

"What has Ukraine come to? Today, 70 percent of children cannot do a simple set of physical exercises," Shevchenko said.

Andreas Umland, a political scientist at the Kyiv-Mohyla Academy, said that political shenanigans are corrupting the democratic process in this former Soviet republic.

"Obviously, the readiness to manipulate politics with all sorts of dubious strategies is high, and includes the active use of politically incompetent, but famous figures," Umland said.

And the celebrities are only happy to oblige. It seems that many of them run for parliament to get the perks and parliamentary immunity enjoyed by Ukrainian lawmakers rather than a desire to serve their nation ? a trend evidenced by the fact that legislators regularly ditch parliament sessions and simply hand their voting cards to their colleagues.

World boxing champion Vitali Klitschko, 40, is also running for parliament, but he has years of political experience and a record of challenging Yanukovych's party in the Kiev city council ? "like a burr under the saddle," as he puts it. With Tymoshenko in prison, his Udar, or Punch, party has gained popularity in recent months and is running neck-and-neck with Tymoshenko's Fatherland party. The two parties' failure to join forces plays into the hands of Yanukovych.

Klitshchko, a tower of muscle, says that competing on Ukraine's political arena, with its dirty tricks and below-the-belt punches, can be harder than fighting in the boxing ring.

"We have declared a fight for Ukraine and we will win it!" he told hundreds of cheering supporters at a campaign rally in Kiev last week.

With the campaign almost over, pollsters say that the use of celebrities has largely failed to sway Ukrainian voters. Korolevska's party is now less popular than before recruiting Shevchenko, prompting her to replace posters showing him and Stupka with just her face.

"This demonstrates the stupidity of our politicians," said Iryna Bekeshkina, head of the Democratic Initiatives Foundation, a polling agency. "At the end of the day our voter, of course, is still far from being rational, but still he is not that stupid."

NEW YORK (AP) ? It's been a big week for technology releases. Microsoft Corp. kicked off its campaign for the Windows 8 operating system and Surface tablet computer, just days after Apple and Samsung refreshed their lineups.

Desktops, laptops and tablet computers running Windows 8 go on sale Friday. That includes the Surface, Microsoft's first foray into manufacturing a general-purpose computer. Friday is also the day people with older machines can buy upgrades to Windows 8.

Windows 8 is a major revamp to Microsoft's industry-leading operating system. It is designed especially for touch-screen computers and requires users to change their habits. The start button at the lower left corner of the screen is gone, for instance.

Microsoft Corp. CEO Steve Ballmer encouraged people to visit a store to try Windows 8 themselves.

"Seeing, touching, clicking and swiping really is believing," he said at Thursday's launch event in New York.

Earlier this week, Samsung released its large-screen Note II smartphone and Apple announced new iPads and Mac computers. Microsoft has an announcement Monday on its Windows phone system, while Google has one on its Android system for mobile devices.

With those announcements, these are some of the gadgets to expect for the holidays:

? APPLE DEVICES

Apple has done well selling its full-sized tablet computer, which has a screen that measures nearly 10 inches diagonally. The iPad dominates the worldwide tablet market, accounting for 70 percent of all tablet shipments in the second quarter of this year, according to IHS iSuppli. But companies such as Amazon.com Inc. and Google Inc. have made in-roads selling tablets with smaller, 7-inch screens and lower price tags.

On Tuesday, Apple said it will start shipping the iPad Mini next week. It will have a 7.9-inch screen, making it slightly larger than those smaller rivals but about two-thirds the size of a regular iPad.

The iPad Mini starts at $329, well above the $159 starting price for Amazon.com Inc.'s Kindle Fire and $199 for Google Inc.'s Nexus 7. Both have 7-inch screens. The Mini will be just $70 cheaper than the 2011 iPad 2, which is still available.

Unlike its rivals, Apple will make a version of the iPad Mini that can access cellular networks from AT&T, Verizon and Sprint. That version will start at $459, compared with $629 for the full-sized cellular model.

Apple is also refreshing its full-sized iPad, giving it a faster processor and faster Wi-Fi capabilities. It will go on sale next week as well.

Meanwhile, Apple unveiled a 13-inch version of a MacBook Pro with sharper, "Retina" display, complementing the 15-inch version unveiled in June.

Apple also updated its iMac line. Some versions will sport a hybrid storage drive that combines the speed of flash memory and the capacity of regular hard drives. They will go on sale in December.

Last month, Apple began selling its iPhone 5. The new phone is bigger, but thinner than previous models and works with faster cellular networks known as 4G.

? PHONE RIVAL

Apple's leading rival, Samsung Electronics Co., came out with a new version of its flagship phone, the Galaxy S III, months ago. But Samsung is known for releasing products throughout the year, each targeted at a different base of consumers.

For those who like to work with a stylus, the Galaxy Note II smartphone came out this week. T-Mobile and Sprint are selling it now. U.S. Cellular will carry it starting Friday. Verizon and AT&T are taking advance orders for shipments in the coming weeks.

The Note comes on the heels of Samsung's campaign touting its Galaxy S III phone as its "next big thing." The Note is even bigger, with a 5.5 inch screen, compared with the S III's 4.8 inches and the iPhone 5's 4 inches, all measured diagonally.

The Note runs the latest version of Google's Android system, Jelly Bean.

? TABLET RIVALS

Amazon's 7-inch Kindle Fire is one of the smaller tablets with decent sales. Last month, it started shipping an updated version with a faster processor, more memory and longer battery life. It also cut the price to $159, from $199, making it far cheaper than the iPad, which starts at $399.

Amazon is also releasing higher-end models under the Kindle Fire HD line. A 7-inch one goes for $199 and an 8.9-inch one for $299. There's also a $499 model that can use the 4G cellular networks that phone companies have been building. A data plan will cost an extra $50 a year. The smaller HD model is already available, while the larger ones will be available Nov. 20.

Barnes and Noble Inc. is also updating its Nook tablets. The new Nook HD will come in two sizes, one at 7 inches (starting at $199) and one at 9 inches (starting at $269). They will be out next Thursday.

In addition to the new HD screen and a lighter body, Barnes & Noble is increasing the services the Nook offers. It's adding a video purchase and rental service, allowing users to maintain different profiles and making it easier to browse titles in its book and magazine stores.

Google has an event in New York next week. All the company is saying is that it has to do with its Android operating system for mobile devices. Google started selling the Nexus 7 over the summer and could use the event to announce an update.

Microsoft Corp. will release a new version of the Windows operating system on Friday, one that's designed to work on both traditional computers and tablet devices.

Several PC manufacturers including Lenovo Group Ltd., Hewlett-Packard Co., Samsung Electronics Co. and Dell Inc. already have announced details about new desktops, laptops and tablet computers.

Microsoft plans its own tablet computer, too. It's new territory for Microsoft, which typically leaves it to others to make devices using its software. Now, it will be competing against its partners.

The Surface tablet will come in two versions, both with 10.6-inch screens, slightly larger than the iPad's.

One model will run on the same type of lower-energy chips used in the iPad. It will start at $499, also like the newest, full-sized iPads. A keyboard cover will cost another $100. That will go on sale Friday.

A heavier, more expensive version will run on Intel chips and be capable of running standard Windows applications. Microsoft hasn't announced the date or price for that yet.

A new version of the Windows Phone system is coming out this fall as well. Once-dominant phone maker Nokia Corp. has been struggling in the shadow of Apple and Android, and it's counting on the new Windows system for a revival. Nokia and Microsoft have unveiled two new devices, but few details are available on when and where they would go on sale.

A year ago, Research In Motion Ltd. disclosed that it was working on a next-generation phone system for the BlackBerry, which now looks ancient next to the iPhone and Android devices. It was supposed to be out in time for this year's holiday season. That won't happen.

In June, RIM pushed the release of BlackBerry 10 devices into early next year, saying it wasn't ready. That means RIM will not only compete with the new iPhone and Android devices out this fall, but it will also have to contend with the new Windows devices.

? PLAYING GAMES

Nintendo's new Wii U game machine will go on sale in the U.S. on Nov. 18. A basic, white model will cost $300. A deluxe black version for another $50 comes with an extra game and more accessories. The GamePad touch-screen controller for it will offer new ways to play.

In "New Super Mario Bros. U.," for example, players holding the old Wii controllers control Mario, Luigi and other characters. The person with the GamePad can help them along by using a stylus to create stepping stones for the characters or stun enemies.

Players can also turn off the TV entirely and play on the GamePad.

Nintendo Co. has been trying to drum up excitement for the Wii U, the first major gaming console to launch since 2006.

The company also announced new entertainment features for the console. Called Nintendo TVii, the service collects all the ways users have to watch movies, TV shows and sports. This includes pay-TV accounts along with services such as Hulu and Netflix. The GamePad works as a fancy remote controller and will let viewers comment on what they are watching.

TVii will be available Nov. 18 as well, at no extra cost.

    (Reuters) - Most U.S. Catholics believe the church should focus more on social justice and the obligation to support the poor, even if it means focusing less on issues like abortion, according to a new poll released Monday by the nonpartisan Public Religion Research Institute.

    The 2012 American Values Survey finding on Catholics goes against the focus of many U.S. Catholic bishops, who have been stressing the church's ban on abortion and artificial contraception in public policy statements. The poll found that 60 percent of Catholics believe in a greater focus on social justice issues rather than abortion, while 31 percent say the opposite.

    The divide was true even among Catholics who attend church once a week or more, a group that is often considered more socially conservative. A slim majority of this group, 51 percent, thought that the church should focus more on social justice issues.

    "The survey confirms that there is no such thing as the ?Catholic vote,'" said Robert P. Jones, CEO of PPRI and co-author of the report. "There are a number of critical divisions among Catholics, including an important divide between ?social justice' and "right to life' Catholics."

    U.S. bishops in this election season have made strong statements opposing same sex marriage, abortion and contraception, particularly in protest of the health care mandate which requires Catholic hospitals and universities to provide insurance that covers artificial birth control, which is against Catholic teachings.

    The survey also found that among Catholics who attend church weekly or more, 57 percent support a prison sentence of life without parole as opposed to the death penalty. This was also true among Catholic conservatives, who supported life without parole over the death penalty by 51 percent to 44 percent, compared to non-Catholic conservatives, who favor the death penalty by 56 percent.

    "The church has clearly had a real impact on Catholic attitudes toward the death penalty, particularly among conservative Catholics," said E. J. Dionne, Jr. Senior Fellow at the Brooking Institution and a co-author of the report, speaking at a press event Monday morning. He noted that Catholics who are more conservative on the abortion issue are more "liberal" on the death penalty.

    The survey also found that the religiously unaffiliated is the fastest growing group in the country's religious landscape, comprising 1 in 5 Americans and more than doubling in size since 1990. The majority were raised in a particular faith, and their reasons for leaving range from a fading belief in God to negative personal experiences with religion.

    Regarding political preferences, the religiously unaffiliated, Hispanic Catholics, non-Christians and Black Protestants were more likely to support President Barack Obama. Nearly 8 in 10 likely supporters of Republican contender Mitt Romney identify as white Christian, including 37 percent who say they are white evangelical, 19 percent who identify as white mainline Protestant, and 19 percent who identify as white Catholic.

    The support for Obama among the religiously unaffiliated was large, by 73 percent to 22 percent, but this group was less likely to say they were certain to vote compared to religiously affiliated Americans.

    "We are not feeling the full force of their presence at the ballot box," said Jones.

    The report found that a third of religiously unaffiliated Americans were ages 18-29. People in this age group were also more likely to support Obama, by 70 percent.

    Dionne said noted that if younger voters continue to vote Democratic, as they have in recent elections, they could represent the "replacement generation" for the old "New Deal" generation of Democratic voters who grew up in the 1930s.

    The survey was taken between September 13 and September 30 before the presidential debates and involved 3,003 respondents, with a margin of error of plus or minus 2 percent.

    Penn Museum unwraps mystery of mummy conservation

    PHILADELPHIA (AP) ? The Penn Museum is unwrapping the mystery of mummy conservation, giving the public an unusual close-up of researchers' efforts to preserve relics from ancient Egypt.

    Human and animal mummies, as well as an intricately inscribed coffin, are among the items undergoing treatment and repair at the Philadelphia institution's newly installed Artifact Lab.

    Housed in a special gallery, the glass-enclosed workspace lets visitors share in "the thrill of discovery," museum director Julian Siggers said.

    "It demonstrates to you the work that's actually being done behind the walls of these galleries," Siggers said.

    Visitors can watch staff members use microscopes, brushes and other tools of the trade to inspect, study and preserve items including the mummy of a 5-year-old girl, several human heads, a colorful but damaged sarcophagus, and a painting from a tomb wall.

    Flat-screen monitors display magnified views of the relics as they are being examined. Conservators will also set aside time twice a day to answer questions from the public.

    The archaeology and anthropology museum has identified 30 objects from its 42,000-piece Egyptian collection to be conserved during the evolving project. Many of the lab items have not been exhibited before because of their poor condition, said conservator Molly Gleeson.

    Among Gleeson's first projects are preserving the mummies of a cat, falcon and ibis. She described the falcon's linen wrappings as frayed and powdery, and noted its precariously attached head would need to be stabilized before the mummy could be displayed.

    Also undergoing study are hieroglyphic-inscribed slabs of wood that comprised the coffin of an Egyptian named Ahanakht, circa 2000 B.C. Conservation efforts led researchers to discover hidden inscriptions on the seams, said David Silverman, curator-in-charge of the Egyptian section.

    Head conservator Lynn Grant said staff members continuously experience a sense of wonder as they work with historical artifacts.

    "It is a delight, with this new space, to be able to share that with our visitors and give people an idea of what's going on behind the scenes," Grant said.

    Localised sunshade could stop Arctic melting

    If we have to hack the planet, we could at least do it with some finesse. Some of the problems with geoengineering could be fixed by targeting specific regions of the planet, rather than cooling everywhere equally.

    A rough modelling study offers a crude blueprint for how to save the Arctic ice cap, but raises questions about who decides which areas to save.

    Devised to stop climate change if attempts to cut greenhouse gas emissions fail or are insufficient to cool the planet, geoengineering schemes range from sucking carbon dioxide out of the air to "sunshades" that block incoming sunlight.

    Sunshades produced by injecting aerosols into the stratosphere have received the most attention as they could be a cheap way to cool the planet. But they are far from perfect.

    Models show that no sunshade can restore both temperature and rainfall to their preindustrial levels. What's more, while average global temperatures could be restored, there would be regional differences. As a result, nations would probably disagree over how much geoengineering to do.

    In a bid to reduce these trade-offs, Douglas MacMartin of the California Institute of Technology in Pasadena and colleagues simulated a more regional approach. They set up a simple climate model in which carbon dioxide levels were doubled, which is expected to happen in the second half of this century.

    Next they modelled three different geoengineering scenarios: a uniform global sunshade, one sunshade over each pole, and a whole-planet sunshade that was thickest over the North Pole and gradually thinned as it spread over the equator and southern hemisphere. They also varied the time of year the sunshades were up.

    Friendly local geoengineer

    The team found that the regional geoengineering approaches gave better results. A uniform global sunshade left some regions sweltering while others were too cold. But with the regional solutions, these disparities were reduced.

    To see if it was possible to restore the Arctic sea ice, which is rapidly melting, MacMartin tried switching a sunshade on above the Arctic during summers only. He found this could restore the Arctic sea ice to its preindustrial extent, while also bringing average global temperatures and rainfall close to their original levels.

    "People complain about setting a global thermostat," says MacMartin. "That's not the right way to think about it. It's an engineering problem."

    Tim Lenton of the University of Exeter, UK, points out that current climate models are nowhere near good enough to make such conclusions. While they do a reasonable job of predicting temperature changes, they give wildly differing predictions for rainfall. As a result, it's not clear what geoengineering needs to achieve in terms of precipitation.

    Lenton is particularly sceptical about the claims for restoring Arctic sea ice, as the model MacMartin used distorts the geography of the North Atlantic to simplify its calculations.

    Geopolitical nightmare

    MacMartin admits that his simulations are "idealised". In the model, he simply turned down the sunlight over different regions of the Earth. In reality, aerosols move around so this level of control may not be possible.

    Nevertheless, his results open the possibility of a more sophisticated form of geoengineering. By combining different techniques, it may be possible to tailor the future climates of different continents, although MacMartin cautions that any change in one region will have knock-on effects elsewhere.

    This will make it harder for countries to agree what to do. Lenton points out that nations would have to decide between them which aspects of the global climate to preserve. "Is protecting the sea ice more important than protecting the Indian monsoon?" he says. "Who decides? It inevitably turns into a power game."

    In an attempt to reduce the inequalities caused by geoengineering, Lenton argues, MacMartin has uncovered even more complicated inequalities that, if anything, make the geopolitical problem worse.
